Following the running of Race 4, a protest was lodged by Mr T.Bambry, the trainer of Its True alleging that Kalgoorlie Bomber or its rider placed 2nd by the Judge interfered with the chances of Its True placed 4th by the Judge. The interference occured at the start of the race.

--

Present at the hearing representing Kalgoorie Bomber were Mr P.Holmes (rider) and Mr B.Hrstich (Mr Kiernan, the trainer, could not be located despite several calls put over the PA system.) For Its True was T.Bambry (trainer) and S.Bambry (rider).

--

Mr Bambry used the video to show the incident that he was concerned about. He alleged that soon after the start, as Ms Bambry had gone forward and was holding her position, Mr Holmes had pulled the left rein of his horse (Kalgoorie Bomber) and pulled him severely sideways to cut Ms Bambry out of the gap and she lost about five lengths.

--

At this point in the hearing Mr McCutcheon, senior Stipendiary Steward, asked if he could comment. He believed that it was the inside horse who had caused the interference not Mr Holmes on Kalgoorie Bomber. He used the head-on film, in slow motion, to clearly demonstrate that the inside horse had rolled in and made contact, not the outside horse.

--

Mr Bambry agreed with Mr McCutcheon's interpretation of the incident and conceded that the protest should go no further.

--

The protest was dismissed and the placings allowed to stand as called by the Judge.
