Following the running of Race 7 Mr. Bosson was charged with careless riding under Rule 871 (1) (d).
Following the running of Race 7 Mr. Bosson was charged with careless riding under Rule 871 (1) (d). The information alleged that O Bosson the rider of Mohican Brave allowed his mount to shift inward causing tightening to Figurinit (V.Johnston) and also Just Looking (K.Myers) in the home straight.
--Mr. Bosson admitted the breach.
--The charge followed a protest where Mohican Brave was relegated from second place to fourth place for causing interference to Just Looking which was placed fourth by the judge.
--The films of the incident had been viewed during the protest hearing however Mr. Goodwin replayed them to outline the events leading to the charge. Mohican Brave was racing approximately four to five horse widths off the fence approaching the final 200 metres. Mr. Bosson, under a hard ride, shifted inwards dictating the line of Figurinit who in turn pushed onto Just Looking causing both horses to be quite severely hampered.
--Mr. George told the committee that Mr. Bossson has not been charged under this rule since November 2004 however he pointed out that for 16 months Mr. Bosson has been on the sidelines. He has only recently, in the last four months, returned to race riding.
--Mr. George requested that the committee look at the degree of carelessness shown by Mr.Bosson and the consequential effects of the careless riding which he suggested were severe. Mr. George submitted that a period of suspension totaling two weeks would be an appropriate penalty.
--Mr.Bosson told the committee that he had rides coming up in the next week that could lead on to some good opportunities and he would prefer the committee to look into a penalty comprising a one day suspension and a fine.
--In response to Mr Bosson's request for a fine Mr.George asked the committee to consider that a monetary penalty for some riders was not a deterrent and in Mr.Bossons situation a suspension was the favoured penalty.

--In coming to a decision on penalty the committee took into account all of the submissions put before it including the fact that two horses were severely affected, the degree of carelessness shown by Mr. Bosson and particularly that a relegation resulted from the incident. The committee also took into account (with regard to rule1122 (2)) that this was a premier race day and the total stakes for the race amounted to $40,000. Mr.Bosson was given credit for his frank admittance of the breach but the committee did not put a great deal of weight on his good riding record considering that he has only been back riding for a short time.
--Taking all of these matters into account it was the opinion of the committee that the penalty could not be covered by one day and a fine as requested by Mr.Bosson.
--We agreed with Mr. George that a period of suspension was warranted and that it must serve as a deterrent to careless riding of this type. The committee also had regard to the riding opportunities for the timeframe.
--Mr. Bosson was suspended from riding from the close of racing on Wednesday September 6th until the close of racing on Thursday September 21st.
