Following the running of Race 1, Woodlands Stud – Standing “American Ideal” and “Bettors Delight” Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr M P Kerr, alleging a breach of Rule 869 (3) (b) in that, as the driver of PAY ME PAINTER, he “drove carelessly when allowing his horse to strike the wheel of NUI THI VAI (S P Walkinshaw) with approximately 1300 metres to run”.

Following the running of Race 1, Woodlands Stud – Standing “American Ideal” and “Bettors Delight” Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr M P Kerr, alleging a breach of Rule 869 (3) (b) in that, as the driver of PAY ME PAINTER, he “drove carelessly when allowing his horse to strike the wheel of NUI THI VAI (S P Walkinshaw) with approximately 1300 metres to run”.
--Mr Kerr had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.
--The breach was found proved accordingly.
--Mrs K R Williams, Stipendiary Steward, showed video replays of the incident. She showed PAY ME PAINTER towards the rear of the field following MEGLO (G A Payne) and outside NUI THI VAI. Mr Kerr attempted to ease down, struck the wheel of NUI THI VAI and broke. There was no pressure from Mr Payne on the outside. Mr Kerr had simply got too close, Mrs Williams said.
--Mr Ydgren informed the Committee that Mr Kerr had been fined $200 in June 2009 for careless driving causing interference. On this occasion, only Mr Kerr’s horse had been affected. Mr Ydgren recommended a fine of $300.
--The Committee took into account Mr Kerr’s admission of the breach and the breach of the careless driving Rule in June.
--Mr Kerr was fined the sum of $300.
