Prior to the running of Race 4 at the Canterbury Jockey Club’s meeting on Saturday 3rd May 2008, Miss T C Newton was charged pursuant to Rule 520 (4) (c) of the Rules of Racing in that it was alleged that she wilfully or without reasonable cause permitted herself to be engaged to ride DREAM MERCHANT at a contract weight of 54 kilogrammes, and failed to make that weight.
Prior to the running of Race 4 at the Canterbury Jockey Club’s meeting on Saturday 3rd May 2008, Miss T C Newton was charged pursuant to Rule 520 (4) (c) of the Rules of Racing in that it was alleged that she wilfully or without reasonable cause permitted herself to be engaged to ride DREAM MERCHANT at a contract weight of 54 kilogrammes, and failed to make that weight.
--Ms Newton pleaded guilty to the charge, which is deemed to be proven.
--Stipendiary Steward Mr S Ching advised the hearing that Ms Newton notified him prior to Race 3 that she could not get her weight below 55 kilogrammes. As a consequence, she was replaced by Ms C Anderson.
--Mr Ching told the hearing that he had discussed the matter at length with Ms Newton and as a consequence he was satisfied that Ms Newton’s actions were not wilful. He said that this was the first time that Ms Newton has been charged pursuant to this Rule.
--Ms Newton told the hearing that she honestly believed that with a bit of effort she would make the contracted weight. She described how she had been wasting, exercising hard and using the sauna but to no avail. She could not get her weight below 55 kilogrammes.

DECISION
--Having heard Mr Ching’s submissions on penalty, we are satisfied this matter can be dealt with by way of fine. We give Ms Newton credit for her good record, and her immediate guilty plea. We set the fine at $200.
