Decision:

Following the running of Race 5, the Clarkson Sign Studio Mobile Pace, an Information Instigating a Protest was filed by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 869(8).  It was alleged that shortly after the start “Lees Approval” (5), driven by Mr L. F. O’Reilly, received a punctured sulky wheel when it was struck by “Auditor General” (12), driven by Mr M. P. Kerr.   The protest was against 4th placing being awarded to “Auditor General”.

Following the running of Race 5, the Clarkson Sign Studio Mobile Pace, an Information Instigating a Protest was filed by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 869(8).  It was alleged that shortly after the start “Lees Approval” (5), driven by Mr L. F. O’Reilly, received a punctured sulky wheel when it was struck by “Auditor General” (12), driven by Mr M. P. Kerr.   The protest was against 4th placing being awarded to “Auditor General”.

Mr M. P. Kerr the driver, and Mr P. F. Kerr the trainer of “Auditor General” attended the hearing.  Mr P. F. Kerr advised that the protest was not contested.

Video coverage of the incident was shown.  After the incident “Lees Approval” had dragged a flat tyre for most of the race and finished in 9th and last place.  The Stipendiary Stewards sought the relegation of “Auditor General” to behind “Lees Approval”.  The amended places are as follows.
