Following Race 10 an information was filed pursuant to Rule 871 (1) (d) when it was alleged by the informant Chief Stipendiary Steward Mr C George that Ms S Spratt allowed her mount to shift in when not clear
Following Race 10 an information was filed pursuant to Rule 871 (1) (d) when it was alleged by the informant Chief Stipendiary Steward Mr C George that Ms S Spratt allowed her mount to shift in when not clear of CULLEMOUR, ridden by P Wells, which was crowded into THE TRICKSTER, ridden by J McDonald, which carried ALL MY COLOURS across the running of NEW MILESTONE which was checked.
--Ms Spratt denied the charge and was represented by her employer, Mr R Yuill.
--Stipendiary Steward Mr N Goodwin demonstrated the video films which clearly showed NEEDUASK, which was being ridden with the whip in the home straight, move inwards and take the line of CULLEMOUR when not the required distance. This inward movement certainly hampered the two runners on her inside, CULLEMOUR and THE TRICKSTER.
--Mr Yuill questioned Mr Goodwin on his interpretation of the film paying particular attention to the further runners inside CULLEMOUR, THE TRICKSTER, and ALL MY COLOURS.
--Mr Yuill then said when asked to make his statement that while Ms Spratt did come across she did stop riding when she caused the interference which he said was only for 2 or 3 strides. He also stated Ms Spratt was not the cause of the tightening to the runners further inside.
--Ms Spratt had little to add other than to say she straightened her mount as soon as she could.
--Mr Yuill then called two witnesses, Mr P Wells, the rider of CULLEMOUR, and J McDonald, rider of THE TRICKSTER. Mr Wells said his horse needed the run and was labouring at the time of the interference. He said he really only had to take a hold of his mount. Mr McDonald said he did have to stop riding for a stride or so but didn't lose much ground.
--Mr George said in his statement that Ms Spratt should have stopped riding as soon as her mount started moving in and the interference would not have occurred.
--DECISION
--The Committee carefully considered all evidence and repeated viewing the video films. It was clear to the Committee that Ms Spratt did allow her mount to move inwards and into the line of CULLEMOUR without being the required distance clear. This caused tightening to CULLEMOUR, THE TRICKSTER, NEW MILESTONE and ALL MY COLOURS. Accordingly we found the charge proven and asked for submissions on penalty.
--Mr George said Ms Spratt did have a good record but in this case three or four horses were affected and he believed a suspension of 3 - 5 days would be appropriate.
--Mr Yuill said the interference was only for 2 - 3 strides after which Ms Spratt straightened, so did not believe it was of a serious nature. Ms Spratt added she did have confirmed rides on the 10th of October at Counties.
--PENALTY
--The Committee took into account these submissions as well as the following :
--- --
- This was a Premier race day with this race having a $40,000 stake. --
- Three horses were affected by the interference.
Accordingly we impose a suspension which starts after racing on 10th October and concludes after racing on 17th October (4 days).
