Decision: Following race 6 an Information was filed pursuant to Rule 871 (1) (d).  The Informant, Mr J Oatham alleged that Mr Callaway allowed his mount SUN VALLEY to shift in 100 metres after the start causing a check to THE PERFECT STORM (T Thornton)


Following race 6 an Information was filed pursuant to Rule 871 (1) (d).  The Informant, Mr J Oatham alleged that Mr Callaway allowed his mount SUN VALLEY to shift in 100 metres after the start causing a check to THE PERFECT STORM (T Thornton).

Mr Callaway admitted the breach.

Mr Williamson demonstrated the video films which clearly showed Mr Callaway let his mount shift in abruptly, crowding and causing a check to THE PERFECT STORM when no more than ¾ length clear of that runner.  This occurred 100 metres after the start.

Mr Callaway stated after hunting his mount out of the barriers, it raced greenly and when he shifted ground inwards he thought he was clear.

PENALTY SUBMISSIONS
Mr Callaway said he had firm commitments to ride at Counties on 19 March 09.
Mr Oatham said Mr Callaway had a fair record with 3 charges in the last 12 months.  He noted that Mr Callaway was riding aggressively for a forward position at the point of interference.  He submitted a 4-6 day suspension would be appropriate.

Mr Callaway said in his opinion his record was not too bad.

The Chairman asked Mr Callaway if he was riding in the South Island, which he confirmed he was planning to travel there in the next 2 weeks.

PENALTY
The committee carefully considered all submissions and before imposing a penalty took into account the following:
1. His guilty plea
2. His record
3.  Level of carelessness mid range.
Accordingly we impose a suspension to start after racing on 19 March and to conclude after racing on 27 March 2009 (5 days).
