DECISION AND REASONS:
Following the running of Race 9, Ashburton Trotting Club Life Members Mobile Pace, Information No. 68334 was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Mr J C Hay, alleging a breach of Rule 869 (2) (a) in that Mr Hay, as the driver of J B’S COURAGE in the Race, “used his whip excessively in the run home”.

The information was filed on raceday and served on Mr Hay at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on 19 March 2010. The information was heard at that meeting.

Mr Hay had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 provides as follows:
(2)   No horseman shall during any race:-
      (a)  use his whip in an unnecessary, excessive or improper manner.

Mrs Williams showed a video replay of the final 400 metres of the Race. She pointed out Mr Hay on JB’S COURAGE improving wide on the track after turning for home. From that point, she alleged, Mr Hay had used his whip on some 21 occasions over the final 200-300 metres with no discernible pauses. The Committee noted that JB’S COURAGE finished 3rd in the Race.

Mr Hay had a clear record, Mrs Williams said. She recommended a fine of $200.

In determining penalty, the Committee had regard to Mr Hay’s admission of the breach and his good record.

--

Mr Hay was fined the sum of $200.
