Following the running of Race 7, Speights Haldon Plate, an information was filed by Stipendiary Steward, Mr S C Ching, requesting a ruling on the following matter:
“Whether I’M DANGEROUS was given a fair start due to the starting gate being slow to open.” Rule 865A.
Following the running of Race 7, Speights Haldon Plate, an information was filed by Stipendiary Steward, Mr S C Ching, requesting a ruling on the following matter:
“Whether I’M DANGEROUS was given a fair start due to the starting gate being slow to open.” Rule 865A.
The connections of I’M DANGEROUS were represented at the hearing of the information by the rider of the horse, Miss A M Mundy, and Licensed Trainer, Mr M L Price, representing the trainer of I’M DANGEROUS, T J Richards.
--Rule 865A provides as follows:
If, in the opinion of the Judicial Committee, a horse which does not finish in a dividend bearing position was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter and may make such order regarding betting as provided for in the NZRB Betting Rules.
The Committee noted that I’m DANGEROUS did not finish in a dividend bearing placing in the Race.
--Miss Mundy told the Committee that her mount had drawn barrier No.6 at the 1400 metres start for Race 7. She said that her gate had opened “sufficiently slow”. It had opened with the other gates but did not “ping as such”. She stated that this had caused her mount to “miss the kick”. The horse generally races handy to the lead – the gate was definitely the reason for her mount to be slow leaving the barrier. It lost “a good 3 or 4 lengths”, Miss Mundy said. All the other horses had “hit the ground” by the time her gate opened. She believed that it was the impact of the gates opening on either side of her that caused her gate to eventually open.
Mr Ching referred to the form lines for the horse’s three previous starts (in the North Island) and submitted that I’m DANGEROUS was a horse that runs on the pace.
--Mr Ching showed head-on and side-on video replays of the start of the Race. He said the there was a “definite delay” in gate 6 opening.
--Mr Price supported the submissions of Miss Mundy.
--The Committee was satisfied, having viewed the video replays and having listened to the submissions of Mr Ching and the evidence of Miss Mundy, that I’M DANGEROUS was prevented from taking an effective part in the Race owing to the mechanical failure of its starting stall. The fact that the gate was slow to open was clear from the head-on video replay. As a consequence, I’M DANGEROUS lost several lengths – estimated at 3 or 4 by Miss Mundy. The horse was not slow away of its own accord. Accordingly, the Committee ruled I’M DANGEROUS to be a non-starter in the Race.
