Following race one an information was filed pursuant to Rule 876(1) when it was alleged by the Stipendiary Steward, Mr Coles, that BENCHMARK placed second by the Judge interfered with the chances of SCISSORMAN placed third by the Judge

Following race one an information was filed pursuant to Rule 876(1) when it was alleged by the Stipendiary Steward, Mr Coles, that BENCHMARK placed second by the Judge interfered with the chances of SCISSORMAN placed third by the Judge. This interference is alleged to have occurred after jumping the second to last fence and approaching the last fence.

The margin between second and third was a nose at the line.

Mr Oatham demonstrated both video films and showed movement outwards from BENCHMARK but clear of SCISSORMAN on his outside.

Mr Peard said in his evidence that the film showed that both horses followed a riderless horse in front which was running out.

Mr Krishna did not wish to give evidence.

Mr Gedge, rider of SCISSORMAN, said the outward movement of BENCHMARK cost him second place.

Mr Scott, part-owner of SCISSORMAN, confirmed Mr Gedge's evidence.

The Committee considered all evidence carefully and repeated viewing the video films. In our opinion both BENCHMARK and SCISSORMAN followed the riderless horse on an outward movement. We do not believe the outward movement of BENCHMARK caused SCISSORMAN the chances of finishing in a better place, accordingly the protest is dismissed.
