An information charging Mr Herlihy was laid at the Morrinsville Trotting Club meeting on the 14th October 2010.  The matter was adjourned for hearing at Cambridge on the 23rd October 2010.

 

Stipendiary Steward Mr T Taumanu alleged Mr Herlihy driving Beau Starlight in race 4 used his whip excessively over the concluding stages of the race.

 

Mr Herlihy signed the information admitting the breach indicating he wished to provide mitigating circumstances.

 

Mr Herlihy was seen to strike the horse 17 occasions over the concluding stages.

 

Mr Herlihy’s horse was going to win but he had a knock from another horse half way down the home straight which necessitated him striking the horse 3 or 4 times in quick succession to regain his concentration.

 

Having being admitted the charge was found proved.

 

Submissions on penalty

Mr Taumanu said Mr Herlihy had an outstanding record and maybe two previous charges for a similar breach in his lifetime of drives.  We consider the breach to be at the lower end of the scale with the JCA guidelines indicating a starting point of a $250 fine.

 

Mr Herlihy accepted the Stewards recommendation.

 

Penalty

Taking into account Mr Herlihy’s outstanding driving record, his guilty plea and with the breach assessed as being at the lower end of the scale the committee ordered a fine of $200.00
