Evidence:

An Information was lodged by Mr Balcombe alleging a breach of Rule 330(3)(c) in that Z Moki was unable to make the contracted weight for AMOR AMOR.

Rule 330(3)(c) states:
A Rider shall not:
(c) fail to ride a horse at the weight at which it is handicapped to carry

Ms Moki said she understood the nature of the charge and confirmed that she admitted breach.

Mr Balcombe explained that on the morning of the races, Ms Moki called Stipendiary Steward Mr Goodwin to inform him that she was overweight and would not be able to get down to the correct weight to ride AMOR AMOR. The stewards were able to get a replacement rider in Ms Hemi.

Ms Moki told the Committee that before contacting Mr Goodwin, she rung the trainer of the horse and advised that she would not be able to make the weight.

 

Decision
As the breach was admitted it was found proved.

 

Penalty Submissions
Mr Balcombe said this was Ms Moki’s fourth weight offence within the last 120 days. Her record shows the following penalties:

12/10/19-Egmont $100
7/11/19-Otaki- $200
5/12/19-Taranaki $300

He said that Ms Moki advised the stewards early, which made it easier to secure a replacement rider.

The Stewards’ submission was for a suspension of Ms Moki’s license.

Ms Moki admitted that she should not have accepted the ride. She thought the horse was a good winning chance and that she would be able to lose the weight required, but failed to do so.
The Committee noticed that Ms Moki had no previous breaches of this Rule before October and asked her if there were any specific reasons for the succession of recent charges.

She explained that since completing her apprenticeship 6 weeks ago, she was not riding as many horses and had failed to compensate for that.

Ms Moki submitted that a suspension would be preferable rather than a more substantial monetary penalty.

 

Reason for Decision:
The Committee took into account all of the submissions. Ms Moki’s recent record of overweight breaches is poor, but she was upfront and honest with the Committee and did not attempt to deflect any blame.

We note that by advising the connections of the horse and the Stewards early, a suitable replacement was found. The punters were not disadvantaged by having an accomplished rider in Ms Hemi take Ms Moki’s place.

We did consider imposing an increased fine; however, due to Ms Moki explaining her situation, it was our opinion that a suspension was more appropriate. Ms Moki is clearly having some difficulty with the transition from apprentice to Class A rider and acknowledged that she needed to work harder to get her weight under control.

 

Penalty:
Accordingly, Ms Moki is suspended for 3 days, from the close of racing on Friday, December 27th up to and including racing on Monday, December 30th 2019.
