DECISION & REASON
--Following the running of race number 11 at the New Zealand Metropolitan Trotting Club meeting on Friday 17th November 2006 and information was lodged by Stipendiary Stewards against Mr J C Hay under Rule 869 (2) (a) alleging that he used his whip excessively over the concluding stages of the race on his horse Flashing Red.
----The information was lodged by the Stipendiary Stewards on 17th November 2006 at 7.00 p.m. and was adjourned to today for hearing.
----At the outset of the hearing the Committee noted that Mr Hay had admitted the breach and did not wish to be heard at the hearing. It was further noted that the information included a recommended fine in the vicinity of $450.00 and that Mr Hay accepted that recommendation. This was confirmed by the Stipendiary Stewards who also advised that in the same race Mr K Larsen (Howard Bromac) had a fine of that amount imposed for a similar breach.
----The video evidence of the evidence was shown to the Committee by Mr N G McIntyre and it was noted that Mr Hay used his whip on Flashing Red until approximately 10-15 metres from the finishing line. It is estimated that in a continuous action he hit the horse in excess of 20 times. The charge is accordingly found proven and a fine of $450.00 imposed.
