Following race 2 an information was filed pursuant to Rule 866(1)(c) when it was alleged by the informant, Stipendiary Steward Mr A Coles, that C Tremayne, rider of CAT?S EYES committed a breach of that rule when she failed to ride her mount out to the end of the race.

DECISION AND REASONS:

--

Following race 2 an information was filed pursuant to Rule 866(1)(c) when it was alleged by the informant, Stipendiary Steward Mr A Coles, that C Tremayne, rider of CAT?S EYES committed a breach of that rule when she failed to ride her mount out to the end of the race.

Miss Tremayne did not admit the charge.

Mr Oatham demonstrated the video, which showed CAT?S EYES ridden by Miss Tremayne in the last 200 metres of the final straight. The horse had the inside running and was being ridden out by Miss Tremayne and was in second place. Although overtaken by STARKY?S STAR Miss Tremayne continued to ride out her mount until 2 strides before the finishing post when she stood up. The loss of momentum of CAT?S EYES allowed the fast finishing MRS KING to catch CAT?S EYES on the line and dead-heat for third place.

In her defence, Miss Tremayne said she was racing on the inside of Leith Innes' mount SYMMETRY and this caused her mount to move in. She stated that she put the whip away and continued to slap the horse on the shoulder. She offered no further evidence.

Mr Coles, in final submissions, said that in his opinion Miss Tremayne cost the chance of CAT?S EYES stakeholders a bigger stake as a result of her riding.

The committee reviewed the videos and all evidence. We have no doubt that Miss Tremayne did stop urging her mount at least 2 strides before the finishing post and as a result allowed the fast finishing MRS KING to share third place.

However, before a decision on penalty is made, submissions from Mr Coles and Miss Tremayne were sought.

Mr Coles said that although Miss Tremayne had a suspension for careless riding to serve she would be free to commence riding after the conclusion of racing on 1 October. He asked for a suspension.

Miss Tremayne said that she had never been charged with failing to ride her mount out before and felt that it was only minor.

PENALTY:

Miss Tremayne, the committee has considered the submissions on penalty and agree with Mr Coles who asked for a suspension. We are concerned with your claim that the offence was only minor and that the owners had only suffered a minor loss of stakes money. We note that you made no reference to the punters who also had their dividends reduced.

We do not agree that this was a minor offence. You clearly stopped riding the horse 2 strides before the post, thus enabling MRS KING ridden by C Lammas to draw even with you.

We do accept that you have a good record, but also note the not guilty plea.

--

--

The integrity of racing is paramount. We can see no reason for you to have stopped riding your mount out.

--

--

Consequently we have come to the decision that you will be suspended from riding from the completion of racing on Saturday 1 October 2005 until the completion of racing on 29 October 2005.
