Decision: --

Jockey H Tinsley was charged under Rule 871 (1) (D) in that being the rider of DAFFODIL in Race 7 at Trentham (The group three First Sovereign Trust Lowland Stakes) he allowed his mount to shift inward near the 1800 metre mark when not clear of ALAGANT SATIN (J Jago), CAN’T KEEP HER DOWN (J Riddell) and BIRD (D Johnson) tightening those runners.

Mr Neal read the rule and H Tinsley confirmed his understanding of the rule and his admittance of the breach.

The film of the incident was shown and the inward movement of DAFFODIL pointed out by stipendiary steward Neal.

Jockey H Tinsley informed the committee that the line of running of the three horses concerned had been affected by his actions. There was calling from the jockeys on his inside and he believed he immediately straightened his mount. He felt the inexperience of some of the jockeys involved in the incident contributed to the tightening.

PENALTY

--

Stipendiary steward Neal informed the committee this was Mr Tinsley’s first charge under this rule since 29 March 2008. His record as a senior rider was very good. He stated that although tightening did occur to three horses it was not at the top end of the scale and it happened at the early stages of the race. He asked the committee to take into account it was a group three race with a total stake of $75,000. Mr Neal believed the incident could be best handled by way of a period of suspension and a $500 fine.

Jockey H Tinsley concurred with Mr Neal that he did ride throughout New Zealand and had a confirmed ride on the last day of the Auckland Cup Week Carnival.

In coming to our decision to suspend and fine Jockey H Tinsley for a breach of Rule 871 we took into account

The early stage in the race the incident occurred

The committee’s belief that the incident was at the lower end of the scale and his confirmation of riding nation wide.

--

However it was a group three race and three horses and their riders were affected. We feel the suspension should begin after Mr Tinsley has fulfilled his riding engagements on the last day of the Auckland Racing Club’s Carnival and that a monetary fine that reflected the race’s stakes should also be imposed.

Mr Tinsley you are suspended from race riding after the completion of racing on Saturday 7 March 2009 until the completion of racing on Friday 13 March and fined the sum of $600.
