Following the running of Race 5, The Little India Desert Gold Stakes Group 3, Mr. K. Smith was charged with careless riding under rule 638 (1) (d). The information alleged he permitted his mount AUNT DAISY to shift inwards approximately 150m after the start causing crowding to KEEP THE PEACE (J. Waddell), A CHANCE TO DREAM (M. Walker) and PEZZAGLIA (J. McDonald).

Following the running of Race 5, The Little India Desert Gold Stakes Group 3, Mr. K. Smith was charged with careless riding under rule 638 (1) (d). The information alleged he permitted his mount AUNT DAISY to shift inwards approximately 150m after the start causing crowding to KEEP THE PEACE (J. Waddell), A CHANCE TO DREAM (M. Walker) and PEZZAGLIA (J. McDonald).

Mr. Smith admitted the breach.

Mr. Oatham used the back-straight films to show Mr. Smith jumping from mid-field then making a gradual movement inward when not clear to do so.  As a result pressure was applied to runners on his inside with Mr. McDonald being the most affected losing his preferred position in what was a Group 3 race.

Mr. Smith admitted the breach but did say that there was already crowding in behind him before he made contact with Mr. Waddell.

Mr. Smith’s riding record showed no careless riding charges in the past 12 months. He was very upfront with the Stewards admitting the breach at the earliest opportunity. Mr. Oatham placed the interference in the mid to low range.

Mr. Smith told the committee that he doesn’t get a lot of good rides but since being back riding for Mr. Grey he was getting more.

Penalty

--

In coming to a decision on penalty the committee considered all of the submissions put before it.  We took into account the degree of interference which we consider to be at the lower end of carelessness. There was no dramatic movement inwards by Mr. Smith but rather steady pressure which occurred early in the race when all runners are generally seeking a good position in the field.  The interference did however happen in a Group 3 race and it is usual for penalties to be higher in “black-type” races. Mr. McDonald was denied his preferred position at that particular stage of the race.

Mr. Smith has an exceptional riding record which we have given him credit for. He is suspended from the conclusion of racing on Monday February 1st until the conclusion of racing on Sunday February 7th which is 5 riding days.
