Following the running of Race 9, Storer Motors Limited Mobile Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against FUTURE FIRE (B N Orange), placed 4th by the judge, on the grounds that FUTURE FIRE “broke late in the run home and across the line being lapped onto by NITRO”, placed 5th by the judge.



DECISION AND REASONS:

Following the running of Race 9, Storer Motors Limited Mobile Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against FUTURE FIRE (B N Orange), placed 4th by the judge, on the grounds that FUTURE FIRE “broke late in the run home and across the line being lapped onto by NITRO”, placed 5th by the judge.

Mr Orange had endorsed and signed the information form “The connections do not contest the protest”. Mr Orange was not present at the hearing of the information.

At the commencement of the hearing, Mrs K R Williams, Stipendiary Steward, sought leave to amend the information to allege a breach of Rule 870 (3) and the Breaking Horses Regulation. She said that the Stewards had reviewed a video replay of the final stages of the Race and were now alleging that FUTURE FIRE had galloped for a distance in excess of 50 metres within the final 200 metres of the Race. Mrs Williams informed the Committee that Mr Orange had indicated to her that he did not contest that allegation.

Mrs Williams showed a video replay of the final 200-300 metres of the Race. She pointed out FUTURE FIRE driven by Mr Orange, nearest the markers, break from its gait prior to the 50 metres marker on the inside of the track and continue in a break to the finishing line, finishing in 4th placing.

The Committee was satisfied, on the basis of the video evidence and Mr Orange’s not contesting the protest, that FUTURE FIRE had broken from its gait within the final 200 metres of the Race, had failed to promptly regain its proper gait, in breach of Rule 870 (3), and had galloped for a distance greater that 50 metres.

Accordingly, the protest was upheld and FUTURE FIRE was disqualified from the Race pursuant to Rule 1003 (2). As a consequence, the amended result for the Race is as follows:
