CHARGES:
--Following race 6 an Information was filed pursuant to rule 638 (1) (d). The Informant, Mr A Coles alleged that passing the 1800 metres, Mr Calder (AMIRAR) angled his mount in when not sufficiently clear of WAITUI MUSIC (Mrs L Satherley) who was checked. This also resulted in crowding to STRAPPED FOR CASH (Miss M Wenn).

FACTS:
--Mr Williamson demonstrated the video films which showed AMIRAR, ridden by Mr Calder, racing in a position 2 from the outside when approaching the 1800 metres. Mr Williamson pointed out to the committee Mr Calder angling his mount towards the rail and in doing so check WAITUI MUSIC. Mr Williamson said AMIRAR was only a bare length clear of WAITUI MUSIC when moving in. The check to WAITUI MUSIC resulted in STRAPPED FOR CASH, who was on its inside, receiving some buffeting. Mr Williamson conceded that WAITUI MUSIC was over racing at the time which contributed to the incident.

SUBMISSION(s):
--Mr Calder said his mount jumped quickly and he thought he was clear of WAITUI MUSIC when angling in. He said he was unaware that WAITUI MUSIC was over racing which he believed made his position worse. However he admitted it was an error of judgement on his behalf as he should have been two lengths clear.

SUBMISSION(s) ON PENALTY:
--Mr Coles said Mr Calder had a very good record with only two charges in the last ten months. He believed Mr Calder’s level of carelessness on this occasion was at the low end but reminded the Committee it was a listed race. He too conceded that WAITUI MUSIC had contributed to the incident by over racing. He submitted a 4 – 5 day suspension would be appropriate.

Mr Calder told the Committee he would like to start the suspension immediately as there were some big race days coming up.

REASON(s):
--The Committee carefully considered all submissions and evidence as presented. Mitigating factors are Mr Calder’s guilty plea, his good record and the part that WAITUI MUSIC had played in the interference. While the Committee believe Mr Calder’s carelessness was indeed at the lower end it must be remembered the interference occurred in an $80,000 listed race. Mr Calder was told that because this charge did occur in a listed race a penalty of 6 days may well have been appropriate. However, taking into account the mitigating factors, we have reduced that to one of 5 days.

After consultation and investigation the Committee is satisfied that Mr Calder has no upcoming commitments to warrant a deferral of the suspension.
----
PENALTY:
--Accordingly after taking all the above factors into account we suspend Mr Calder from riding in races which is to start after racing today (31 July 2010) and conclude after racing on 8 August 2010. (5 days)
