The Defendant, Mr C Ormsby, is charged with breaching Rule 871(1)(d), namely in that ? ?C Ormsby riding TEMPLE HILLS, No.3, angled into a marginal gap near the 100 metres causing a sharp check to TRAVELLIN MAN, No.1,?.

DECISION AND REASON:

The Defendant, Mr C Ormsby, is charged with breaching Rule 871(1)(d), namely in that ? ?C Ormsby riding TEMPLE HILLS, No.3, angled into a marginal gap near the 100 metres causing a sharp check to TRAVELLIN MAN, No.1,?.

Mr C Ormsby (Apprentice Jockey) was assisted by his employer, Mr L O?Sullivan. Mr Ormsby denied the charge.

Stipendiary Steward, Mr A Coles, gave evidence. He demonstrated the incident on the various race videos (head-on and side-on). Mr Coles said that Mr Ormsby angled into a gap at approximately near the 100 metre mark and caused a sharp check to TRAVELLIN MAN.

Mr Craig Grylls (Apprentice Jockey) rider of TRAVELLIN MAN, No.1, gave evidence that Mr Ormsby, TEMPLE HILLS, NO.3, cut in front of him when not sufficiently clear. He said that he consequently suffered a sharp check.

Mr O?Sullivan gave evidence and made submissions.

After carefully reviewing the evidence and race videos the Committee found that Jockey Ormsby (TEMPLE HILLS) angled into a gap near the 100 metre mark, resulting in a sharp check to TRAVELLIN MAN, ridden by Apprentice Craig Grylls.

Mr L O?Sullivan (employer) for his apprentice C. Ormsby, conceded that interference had occurred but his movement was caused by LITTLE JESS, No.6, moving in slightly on his outer. The Committee accepted that there was movement from LITTLE JESS, No.6, and slight movement from TEMPLE HILLS, No.3.

Mr LN McCutcheon contended that the gap was always marginal and Mr Ormsby had angled in for a run when there was insufficient room. The Committee accepted that there was outward movement on either side of Mr Ormsby but he has to take responsibility for his decision to angle in, in the first instance. On that basis the charge of careless riding was found proved.

Mr C Ormsby, Apprentice Jockey, was found guilty of careless riding (Rule 871(1)(d)).

Penalty:

After hearing submissions on penalty from Mr LN McCutcheon and Mr L O?Sullivan, the Committee determined that a suspension be imposed.

--

Taking into account Mr Ormsby's prior riding record, the explanation provided by Mr L O?Sullivan and that the horse TRAVELLIN MAN, No.1, suffered a sharp check, Mr Ormsby was suspended from the conclusion of racing on the 8 March 2006 up to and including racing on the 18 March 2006 (4 days).
