DECISION & REASONS:
--An Information was lodged by Stipendiary Steward Mr J Muirhead against Mr N Chalmers, driver of ASHTAR COMMAND alleging a breach of Rule 869(3)(b) ? Careless Driving ? in that he tightened three horses on the inside of ASHTAR COMMAND racing into the first bend, resulting in PRIDE AND PREJUDICE driven by Mr O Gillies, being forced over the marker pegs and breaking from its gait. Mr Chalmers admitted the breach and did not wish to be present at the hearing. Endorsed on the Information was the following, "On Mr Shaw's advice, we wish not to attend and are asking for a suspension. Stewards indicated a period of two days".
--Mr Muirhead demonstrated the incident by use of the video film. ASHTAR COMMAND started from barrier position six on the front row and after beginning well moved inwards to follow TYLER?S IMAGE which went to the lead. However, going into the first bend, the inward movement of ASHTAR COMMAND tightened three horses racing on its inside resulting in PRIDE AND PREJUDICE being forced over the marker pegs and breaking from its gait. Mr Muirhead suggested either a fine of $250 or a two-day suspension.
--In fixing penalty, the Committee took into account the following matters:

- The guilty plea. --
- The submissions of Mr Muirhead. --
- The preference for a suspension on the part of Mr Chalmers. --
- Mr Chalmers having no relevant breaches of the rules recorded against him. --
- The offending was at the upper end of the scale.
Balancing those matters, but with particular reference to the seriousness of the offending, the Committee suspended Mr Chalmers' horseman's licence for three days, that is to the end of racing on the 11th of August 2006. It was fortunate that only one horse broke as a result of Mr Chalmers' careless driving.
