Decision: Under Rule 871 (1) (d) : Ms C Spittles, with the assistance of Mr M Pitman, admitted a charge of careless riding in that she allowed her mount JACKSON JONES to shift inwards causing Mr GILLIGAN to check and crowding MUGS AWAY and BRING IT ON when not sufficiently clear near the 1300 metres.

Under Rule 871 (1) (d) : Ms C Spittles, with the assistance of Mr M Pitman, admitted a charge of careless riding in that she allowed her mount JACKSON JONES to shift inwards causing Mr GILLIGAN to check and crowding MUGS AWAY and BRING IT ON when not sufficiently clear near the 1300 metres. We thus find the charge proved.

Mr Ching demonstrated on the video that shortly after the start Ms Spittles who had started from an outside barrier had angled her mount across the field when not sufficiently clear causing one horse to check and crowding 2 others. Ms Spittles stated she had looked and JACKSON JONES, which was somewhat unco-ordinated, had anticipated her inwards movement and she had thus moved across more quickly than anticipated. She stated she had taken corrective action. All parties agreed that this was unfortunately too late and interference had been caused as a consequence of Ms Spittles’ actions.

We accept Mr Ching’s analysis of the breach as being mid range, although we see it at the lower end of this. He has asked for a penalty of 4 to 6 days suspension. We take a starting point of 5 days and give a two day discount for Ms Spittles’ excellent riding record, her ready admission of the breach, that JACKSON JONES is a hard horse to ride and she did eventually take corrective action. As with earlier penalty decisions, we propose to regard a premier day as 1½ days. We believe a 3 day suspension to be appropriate which we equate to 2 premier days.

Subsequent to the imposition of penalty Ms Spittles’ employer, Mr Parsons, who was not present on the day, has asked that the penalty be deferred. As this is within the 7 day period and NZTR does not demur, the Committee defers the penalty. Ms Spittles is suspended after racing on 8 November up to and including Saturday 15 November 2008.
