DECISION & REASON :
--An information was filed pursuant to Rule 520 (4)(c) by Stipendiary Steward , Mr J Oatham . He alleged that Mr D. Stackhouse failed to make the agreed weight for EQUALS THAT in Race 1
--Mr D Stackhouse pleaded guilty and was represented by Mr G Richardson.
--Mr Oatham said Mr Stackhouse could only claim 2 kg and not the full 3 kg allowance, Mr Priscott the trainer of EQUALS THAT was not happy and replaced him with Mr D Leung.
--Mr Oatham informed the Committee that Mr Stackhouse had received a warning for breaching this rule at Tauranga on the 21st June 2008 and at Riccarton on the 27th of June 2008.
--Mr Oatham said Mr Stackhouse was making a genuine attempt to keep his weight down .He submitted a $ 150 Fine would be appropriate.
--Mr Stackhouse confirmed Mr Oatham submissions to be correct and had nothing further to add

PENALTY:
--The Committee considered all submissions and before imposing a penalty highlighted to Mr Stackhouse that it was a major concern that this was the third consecutive week that he had trouble managing his weight. On this occasion a $150 fine was imposed.
