In Race 1 at Riccarton on Saturday 31st March Mr I Khairil was the rider of BOOTMAN which had barrier draw 13 in a 14 horse field. Approximately 100 metres from the start Mr Khairil commenced an inward movement and caused significant interference to SKIVE, WELLESLEY and DIVISION.

As a consequence Mr Khairil was charged with careless riding pursuant to Rule 871 (1)(d) of the Rules of Racing. Mr Khairil is an apprentice jockey to Mr Murray Hamilton of Omakau. He was accompanied in the hearing by Mr Ben Gordon, Licensed Trainer and a co-trainer of BOOTMAN.

Mr Khairil pleaded guilty to the charge which is therefore deemed to be proved.

The incident was demonstrated to us by Mr M Humphreys, Assistant Stipendiary Steward, from the video coverage, from the 600 metre camera (head on) and the "Start cam". Mr Khairil's inwards movement was sharp and several horses which were running on a straight line were inconvenienced as described in the information.

SUBMISSIONS ON PENALTY

Mr Ching submitted to us that Mr Khairil's actions were at the high end of the "careless" scale and were bordering on reckless. He suggested to us that rider safety was compromised. He told us that Mr Khairil lacked experience having had only 74 race day rides. He submitted that a suspension was called for. He suggested that credit should be given for Mr Khairil's guilty plea.

Mr Ben Gordon, Licensed Trainer, submitted to us that Ms Michelle Carston, also an inexperienced rider, who was first affected by Mr Khairil's actions, should have called out but because of her inexperience she didn?t. Mr Gordon also said that "sitting in the stand" would not help Mr Khairil gain experience. We note that Mr Khairil rides in the South Island only.

PENALTY DECISION

We acknowledge Mr Khairil's inexperience and give him credit for his guilty plea. However, this was dreadful riding on Mr Khairil's part and we are in no doubt that Mr Ching would have been quite justified in bringing a more serious charge of reckless or even dangerous riding. Horses could easily have fallen and may well have done had it perhaps not been for the experience of at least two of the riders affected.

Particular care is required by jockeys when drawn wide. Jockeys must ensure that they remain their own horse length and another length clear when moving across.

We are sympathetic to Mr Gordon's remark that an apprentice jockey does not gain experience from "sitting in the stand". However, because of the seriousness of the incident, a suspension is the only penalty that can be imposed. Such a penalty is in line with the general policy of suspending apprentice riders.

Mr Khairil is therefore suspended from Race riding from the conclusion of racing today the 31st March 2007 until the conclusion of racing on Friday 27th April. That is 6 South Island racing days.
