Decision: Following the running of Race 9, Recreation Hotel Handicap Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against HEZA BRITE NATIVE (M P Jones), placed 1st by the judge, on the grounds of interference to CATHY COMBO (L D McCormick), placed 12th by the judge, with approximately 1300 metres to run.
DECISION AND REASONS:
Following the running of Race 9, Recreation Hotel Handicap Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against HEZA BRITE NATIVE (M P Jones), placed 1st by the judge, on the grounds of interference to CATHY COMBO (L D McCormick), placed 12th by the judge, with approximately 1300 metres to run.
Mr M P Jones, the driver and part-owner of HEZA BRITE NATIVE, represented the connections of that horse at the hearing of the information. Mr McCormick was also present and was assisted by Licensed Open Horseman, Mr C D Thornley.
--Mr McCormick said that, with approximately 1300 metres to run, he was sitting in the parked position when HEZA BRITE NATIVE came round 3-wide and had not cleared his horse when he crossed it. There was contact and CATHY COMBO broke and lost its chance.
--Mr Escott then showed video replays of the incident. Mr McCormick stated that there was no inconvenience caused by the leader, DALRIADA ABBE (S R McNally), drifting out. Mr McCormick said that he had taken hold of his horse, just prior to it galloping, to let Mr Jones go round to give him cover.
--The exact point at which contact was made was shown by part of the wheel disc of CATHY COMBO breaking and becoming airborne. It was visible on the video replay. Mr Jones submitted that it showed that, before the point of contact, CATHY COMBO had already gone off stride. Mr Jones said that he had crossed CATHY COMBO before the contact was made and that horse was in a gallop when contact was made.
--Mr McCormick said that, looking at the video replay, it did appear that CATHY COMBO had galloped and then struck the wheel of HEZA BRITE NATIVE. Mr Thornley agreed that this appeared to be the case. Mr McCormick, when questioned by Mr Escott, said that having seen the video replays there was no ground to relegate HEZA BRITE NATIVE.
--Mr Escott then sought leave to withdraw the protest. Leave was granted accordingly. The judge’s placings for the Race stand.
