Following race 10, an information was lodged by Stipendiary Steward Mr C J Allison, under Rule 869.2.a, that Mr A W Scobie, driver of MAN IN BLACK, used the whip excessively over the final stages.
Following race 10, an information was lodged by Stipendiary Steward Mr C J Allison, under Rule 869.2.a, that Mr A W Scobie, driver of MAN IN BLACK, used the whip excessively over the final stages. Mr Scobie admitted the breach.
--Mr Allison used the Trackside and head-on video clips of the alleged breach, stating that Mr Scobie used the whip 26 times from the 200 metre mark to the winning post on MAN IN BLACK. Mr Scobie stated that his horse was finishing on and his whipping action was not a full blown strike, but a quick wrist action.
--DECISION & REASON :
--In fixing penalty, consideration was given to the following :

- Mr Scobie's guilty plea and frank and open admission. --
- Mr Scobie has incurred three previous breaches of this Rule in the past twelve months, namely at
- Wyndham 19/11/2006 - fined $250
--- Wyndham 03/03/2007 - suspended 2 days
--- Forbury Park 10/05/2007 - fined $250 and suspended 4 days
--Mr Scobie was suspended up to and including 29 November 2007 (8 days) and warned any further breaches of this Rule, in the current racing season, will incur a severe suspension of his horseman's licence.
