Decision:

The information alleges that Fizz on its rider placed 2nd by the Judge interfered with the chances of Tommie placed 4th by the Judge.



Information 31782 alleges that Fizz on its rider placed 2nd by the Judge interfered with the chances of Tommie placed 4th by the Judge. The alleged interference occurred in the final stages of the race.

Mr O?Sullivan was not present at the meeting and was represented by Licensed Trainer D Haworth. Mr B Herd the rider of Tommie informed the Committee he had spoken on the phone to Mr Baker that horse's trainer and that he was happy for Mr Herd to represent him.

The rule was read by Mr Goodwin and all parties acknowledged they understood same. Mr Goodwin also reserved the right to charge any rider involved in the alleged incident.

Mr McCutcheon then showed those present head on and side on videos of the alleged incident.

--

It was his view that J Waddell the rider of Fizz had moved out 3 to 4 horse widths whilst still riding with the whip and taken the line of Mr Herd's mount Tommie.

The films also showed Mr Herd had to check his mount when it clipped heals with Fizz.

Tommie was beaten a nose for 3rd. When asked neither Mr Haworth nor Mr Waddell had any questions of Mr McCutcheon or his interpretation of the film.

Mr Haworth asked Mr Herd did he have to stop riding his horse with the whip, Mr Herd replied he did.

Mr Waddell said for his part it appeared he had definitely cost Mr Herd's mount running 3rd.

Mr Goodwin in summing up said the films in his opinion clearly showed Mr Herd having to check his mount and that the margin between 3rd and 4th was only a nose.

All parties acknowledged that they had had a fair hearing and had nothing further to add and left the Judicial Room.

When arriving at a decision the Judicial Panel took into account all of the evidence both verbal and the films shown to them.

--

They were of the view that the outward movement of Fizz into the line of Tommie had definitely caused the rider of Tommie to check his mount and lose momentum, they were also of the view that the loss of momentum had cost Tommie 3rd placing and therefore exercised their discretionary powers and placed Fizz immediately behind Tommie. The amended placings were 8-5-12-10-9-3.

Decision:
