This is an information filed by Stipendiary Steward Mr J. Muirhead against Junior Horsewoman Ms K. Blakemore driver of IN TIME alleging a breach of the above in that she improved her horse from two wide to three wide with about 1650m to run forcing BET YOUR LIFE driven by Mr D. Branch to race wider on the track.

This is an information filed by Stipendiary Steward Mr J. Muirhead against Junior Horsewoman Ms K. Blakemore driver of IN TIME alleging a breach of the above in that she improved her horse from two wide to three wide with about 1650m to run forcing BET YOUR LIFE driven by Mr D. Branch to race wider on the track.

Ms Blakemore, after having received advice from Senior Horseman Mr S. Reid, admits the breach and is present at the hearing assisted by her father, trainer Mr D. Blakemore.

Mr Muirhead showed the film of the incident.  Ms Blakemore moved her horse outwards at a time when BET YOUR LIFE was improving on its outer and was about a half length behind.  BET YOUR LIFE was forced to race wider on the track.

Ms Blakemore said that her horse was pulling hard and making a noise like it was going to choke and so she was looking to get out of trouble.  Mr Blakemore said that after the race the horse was found to be severely bleeding from a knee and this could possibly have contributed to the incident.

Penalty:

--

Mr Muirhead approached penalty on the basis that the offending was simply a breach of the Push Out Rule.  He said the recommended starting point was a fine of $250.00, Ms Blakemore had a clear driving record and the offending was mid range on the scale of seriousness.  Mr Muirhead recommended a fine of $200.00.

Ms Blakemore accepted that recommendation.

In fixing penalty the committee takes into account the guilty plea, Ms Blakemore’s clear record, the submissions of Mr Muirhead and the acceptance of them by Ms Blakemore, the recommended starting point, Ms Blakemore’s junior horsewoman’s status and agrees that the offending is about mid range on the scale of seriousness.  Importantly the Committee also takes into account the mitigating factors put forward, these were not disputed by Mr Muirhead.  Balancing those matters but with emphasis on the mitigating factors a fine of $150.00 is imposed.
