Following race 10 an information was filed pursuant to Rule 856(1) requesting a ruling as to whether the rider of the 3rd placed horse IL GIOCATORE weighed in correctly.

DECISION & REASON:
--Following race 10 an information was filed pursuant to Rule 856(1) requesting a ruling as to whether the rider of the 3rd placed horse IL GIOCATORE weighed in correctly.
----Mr Oatham in his submissions said he was in attendance at the scales when it was brought to his attention that Ms Wenn had entered the Lady Jockeys Room prior to weighing in. When called Ms Wenn had immediately reappeared with her gear and been directed into the Judicial Room with the siren sounded.
----Ms Wenn said she walked in to the weigh in area, and whilst talking to two people was not concentrating and took two steps into the Lady Jockeys Room. She said she still had her gear under her arm and it was then that she heard an official call out reminding her to weigh in. She immediately retraced her steps and was told go in to the Judicial Room with her gear still under her arm. Mr Oatham after speaking with Ms Wenn then instructed her to weigh, which showed the correct weight.
----Mr Richardson co-trainer of IL GIOCATORE said that it was only a matter of two steps whilst Ms Wenn and her gear was still intact.
----Mr B Smith (Weigh-In Steward) said that he was following Ms Wenn in to weigh and while his vision was obstructed behind a pole Ms Wenn moved in to the Lady Jockeys Room. He said he then called out to her and she immediately came out.
----Mr C Neil (Clerk of Scales) said he had weighed in the first five horses and was not aware of the situation. He then heard Ms Wenn being called and she appeared immediately. He confirmed her weight was correct when she was called to weigh.
----Evidence was called from Miss S Collett who said that she had a clear view of Ms Wenn when she entered the Lady Jockeys Room and verified that Ms Wenn did not put her gear down or touch anyone.
----Ms Cropp was also called to give evidence and confirmed the statement of Miss Collett.
----DECISION:
--The Committee carefully considered all evidence. It is clear to us after hearing from the witnesses that Ms Wenn only took two steps inside the Jockeys Room, did not put her gear down or come into contact with any person. She immediately came out when called and weighed in correctly. Accordingly we are satisfied that the weighing in of IL GIOCATORE was not compromised and the Judges placings shall stand.
