Mr J Davidson, stipendiary steward, alleged that Mr J Bullard, the rider of HIGH TIDE, allowed his mount to shift inwards when insufficiently clear of WISH ME LUCK (L Robinson) causing that horse to check near the 150 metres.
----Mr J Davidson had Mr M Davidson, assistant stipendiary steward, demonstrate on the videos that Mr Bullard allowed his mount HIGH TIDE to come across and check WISH ME LUCK. He has demonstrated that Mr Bullard was not his length plus another length clear. He acknowledged that, while Ms Williams had moved out, there had been no contact with that horse and it had not contributed to the incident.
----Mr J Davidson called Mr Robinson who stated he was checked as a consequence of movement from a horse on his outside in the Pitman colours. In response to questions from Mr J Davidson, he said he was entitled to be there and had clear running until the interference occurred. He said the movement was at least one horse width. He said he clipped heels as a consequence of the inwards movement.
----Mr Bullard said he had been held up behind Mr Bates, and his horse had over-reacted and taken an extra stride, before ducking in. He said it was after he had used the stick a couple of times, and that had he had pulled his horse off Mr Robinson as soon as possible. He said his riding was not careless in that his horse had been racing erratically and had run away from the stick. He agreed he had moved at least one horse width and said he had not realised his mount had moved across so much.
----We have viewed the videos on a number of occasions in normal and slow speed and find we agree with the description of the incident given by Messrs Davidson. We do not accept Mr Bullard's statement that his inwards movement was abrupt, but in our view he continued to shift in for some 4 to 5 strides. While Ms William's mount does move out we do not believe this movement contributed to the incident. At the time Mr Bullard moved, he was not his length plus another length clear of WISH ME LUCK. As a consequence he moved into the line of Mr Robinson who, we observed, had to twice stop riding his horse. We note Mr Bullard's mount screwed sideways as a result of the contact. We accept when Mr Bullard first moved there was a gap. But as he moved across he permitted his mount to roll into the line of Mr Robinson. He did not try to straighten his horse until after contact was made. This was too late. We thus find the charge proved.
--We see the breach as being mid range. Mr Bullard has had three suspensions this season, each of three days. Mr Bullard has indicated that he has a ride at Rotorua and we observed that acceptances are out. We suspend Mr Bullard from riding at the end of racing on Wednesday 14 February up to and including Wednesday 21 February 2007. This is three days.
