DECISION AND REASONS:
--Mr Bell has admitted a charge of careless riding in Race 2, Wilsons Sports Bar & TAB Maiden, in that, as the rider of DIAMOND JET, he shifted ground inwards when not clear making contact with STREET LIGHT (N Collett) and taking her off her rightful line. The charge was found proved.
----Assistant Stipendiary Steward, Mr J M McLaughlin, showed video replays of the incident which took place approximately 400 metres from the finish of the Race, just after the field entered the home straight.
----Mr Bell said that he did not initially see Miss Collett on his inner and that he was approximately half a length in front of her when he shifted inwards.
----Licensed Trainer, Mr S A Marr, who was assisting Mr Bell, submitted that it was an error of judgment on the part of Mr Bell who was riding competitively.
----Mr Ching submitted that Mr Bell should be given credit for his guilty plea. He informed the Committee that Mr Bell had received a 3 days' suspension in October 2006 for careless riding. He said that, in his view, the breach was in the medium range and that a suspension was called for.
----Mr Bell informed the Committee that he is employed by trainer, Mr G Searle, at Palmerston North and rides principally in the Central Districts. He is aged 19 years and has been riding for approximately 2 years. He has had approximately 800 career rides and has received only the one suspension referred to.
----Mr Bell informed the Committee that he has declared rides at the Foxton meeting on Friday, 10 August, and at Riccarton on Saturday, 11 August. Mr Marr confirmed that Mr Bell was engaged to ride one of his stable runners on Saturday.
----The Committee believes that the starting point for a careless riding breach in this range is 5 days. However, taking into account:

the Committee has determined that a suspension of 3 days is appropriate in this instance and Mr Bell will be suspended from the close of racing on Saturday, 11 August next, up to and including Saturday, 25 August next, effectively 3 riding days.
