An Information was lodged by Stipendiary Steward Mr JM Muirhead against Miss P Wakelin the driver of SUN LAD alleging a breach of the above Rule ? Careless Driving ? in that she drove SUN LAD carelessly

An Information was lodged by Stipendiary Steward Mr JM Muirhead against Miss P Wakelin the driver of SUN LAD alleging a breach of the above Rule ? Careless Driving ? in that she drove SUN LAD carelessly striking the sulky wheel of BE EARLY with approximately 150 metres to run causing her own horse to break and losing its chance.

Miss Wakelin admitted the breach of the Rule but wished to be present at the Hearing.

The relevant Rule was read out to Miss Wakelin and she acknowledged understanding it.

Mr Muirhead demonstrated the incident by use of the video film which showed that prior to the 150 metre mark Miss Wakelin moved SUN LAD out from a trailing position and in search of a gap and in doing so she struck the wheel of BE EARLY causing her horse to break and lose its chance. Mr Muirhead was able to demonstrate the incident from several different angles.

Miss Wakelin acknowledged that she had made contact with the sulky wheel of BE EARLY but said that when she moved her horse out it floated and ran out quicker than she expected. She did however readily acknowledge that as the Driver of the horse it was her responsibility to firstly keep her horse under control and secondly not to come into contact with any other horse or sulky. Miss Wakelin was honest and forthright in her evidence and acknowledged her responsibility.

The parties were asked for recommendation as to penalty and Mr Muirhead recommended a fine in the range of $250 - $500. Mr Muirhead did however point to Miss Wakelin's excellent driving record and that the fact that she was open and honest about the incident.

Miss Wakelin accepted that a fine would be imposed.

In fixing penalty the Chairman took into account the following matters:

(a) The guilty plea

--

(b) The submissions of Mr Muirhead

--

(c) The submissions of Miss Wakelin

--

(d) Miss Wakelin's excellent driving record

--

(e) The fact that Miss Wakelin was open and honest when faced with the charge

--

(f) The evidence as a whole.

--

--

Balancing all of those matters the Chairman decided to impose a fine of $300.00 on Miss Wakelin.
