Decision: -- Following the running of Race 10, The Golden Coast Chartered Club Mobile Pace, an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr P. J. Scaife, the driver of "Point Mr Holme" (11), alleging a breach of Rule 862(2). It was alleged that Mr Scaife failed to maintain his correct barrier position in this mobile start race. Following the running of Race 10, The Golden Coast Chartered Club Mobile Pace, an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr P. J. Scaife, the driver of "Point Mr Holme" (11), alleging a breach of Rule 862(2). It was alleged that Mr Scaife failed to maintain his correct barrier position in this mobile start race. Mr Scaife had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing. He also agreed that he understood the charge and the Rule it was brought under. Stipendiary Steward Mr Renault used video coverage to illustrate the start of this race. Mr Taumanu said that Mr Scaife had drawn barrier two on the second line, but that he had positioned his horse on the outside of the front line. As a result the starter had no option but to declare a false start, and because of this the race was approximately six minutes late in starting. In explanation Mr Scaife said that he thought he had drawn the outside of the front line. Penalty: Mr Taumanu advised that Mr Scaife had no relevant previous convictions, and that as he had admitted the breach he recommended a fine of $200-00. We adjourned to consider the matter of penalty. We were satisfied that the penalty recommended by Mr Taumanu was very fair in the circumstances. On returning to the Enquiry Room the parties were advised that Mr Scaife would be fined the sum of $200-00 as recommended. J. M. Phelan Chairman
