Following race 4 an information was filed pursuant to rule 638 (1) (d).  The informant Mr Williamson alleged that near the 300 metres MUCH TOO MUCH ridden by Mr D Stackhouse shifted out when not clear forcing IF ONLY (A Calder) out into the line of LISA ANNE (C Parish) who clipped a heel losing ground.

FACTS:

--

Mr Robinson demonstrated the video films which clearly showed at a point near the 300 metres Mr Stackhouse angle his mount MUCH TOO MUCH out sharply to gain a run.  In doing so he moved into the line of IF ONLY who in turn took the line of LISA ANNE causing this horse to clip heels.

SUBMISSION(s):

Mr Stackhouse said the gap had closed in front of him and as his mount was full of running he angled out for a clear run.  However he admitted he was not aware of Mr Calder racing just behind him.

Mr Jenkins said it was noticeable that MADAM ZENNO who was racing directly in front of Mr Stackhouse had moved in closing a gap which Mr Stackhouse was about to take. Mr Jenkins said this was the cause of Mr Stackhouse moving out for a run.

SUBMISSION(s) ON PENALTY:

Mr Williamson conceded that MADAM ZENNO had moved in slightly causing Mr Stackhouse to move out.  However he said this should not allow Mr Stackhouse to angle out when insufficiency clear which he subsequently did.  Mr Williamson said this was Mr Stackhouse’s fourth charge in the last 12 months but because of the mitigating factor above submitted this charge was at the low end of carelessness.

Mr Stackhouse submitted he had rides up to and including 24 October.

The committee considered all evidence and submissions as presented.  Mitigating factors are Mr Stackhouse’s admission of the breach, his good record for the number of rides he has and the contribution to the incident by MADAM ZENNO.  However Mr Stackhouse clearly angled out on his own accord without being the required distance clear.

PENALTY:

Accordingly after considering all the above we impose a suspension on Mr Stackhouse from riding in races which is to start after racing on 24 October and conclude after racing on 29 October 2010 (4 riding days)
