Facts:
Following the running of Race 10, Wallaceville Estate Wellington Cup, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d). The Information alleged that Alysha Collett shifted in after the start when not sufficiently clear making heavy contact with SLY ROMANCE.

 

Prior to hearing any evidence Ms Collett addressed the Committee and requested a deferment of the charge to either tomorrow or another meeting in order to seek representation and advice from other people on the films.

 

Mr Oatham opposed a stay saying that for charges heard on a race day riders were not permitted representation and Ms Collett was a senior rider with considerable experience. He said this was not a charge of any major significance or seriousness and it was very difficult to get all parties together on another day.

 

The Judicial Committee asked Ms Collett to expand further on her reasons for seeking an adjournment. She said she needed more time to prepare and go through the films with a racing mentor of hers. Further she had a plane to catch and had to leave the racecourse in 30 minutes. Ms Collett said she did not feel mentally well enough to proceed with the hearing at the present time.

  

The Committee adjourned briefly to consider Ms Collett’s request.

 

Decision on Adjournment:
Ms Collett’s charge of careless riding arose following an incident in Race 10 on the programme, the Wallaceville Estate Wellington Cup. This was the second to last race of the day. The hearing into the charge did not begin until well after the last race at approximately 5.45pm. Ms Collett told the Committee that in order to catch her flight she would have to leave the course at 6:15. This was a defended hearing and the RIU indicated they would be calling a witness. Ms Collett said she did not feel “mentally well enough” to hear the charge today.

 

Representation is not permitted for charges heard on race day and the request for such is not, on its own, a valid reason for the granting of an adjournment. Adjourned race day charges are usually for those considered more serious than careless riding and those that may attract more severe penalties.

 

Based on the specific set of circumstances today, in particular that the hearing was to be held after the last race of the day, the fact that there were time constraints (defended breaches are generally more lengthy) and Ms Collett advising she did not feel well enough to proceed at the current time, the Committee granted an adjournment, the hearing to take place at a day and time advised by the JCA.

Mr Oatham requested that the Stewards objection to the deferment be recorded. He said it was a licensed jockey’s obligation to be ready and able to face charges on race day and their travel arrangements should be made accordingly.
