Decision:
Following the running of Race 10, Mainland Minerals/Buy on-Line Staysound NZ Ltd Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr R J Alfeld, alleging a breach of Rule 869 (4) in that, as the driver of ARMA XCELLENT in the Race, he “drove in a manner causing his own horse to break with approximately 900 metres to run when attempting to shift CENTENARY (S J Thompson) wider on the track”.
DECISION AND REASONS:
--Following the running of Race 10, Mainland Minerals/Buy on-Line Staysound NZ Ltd Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr R J Alfeld, alleging a breach of Rule 869 (4) in that, as the driver of ARMA XCELLENT in the Race, he “drove in a manner causing his own horse to break with approximately 900 metres to run when attempting to shift CENTENARY (S J Thompson) wider on the track”.

Mr Alfeld had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Rule 869 (4) provides:
--No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.

Mr McIntyre showed a video replay of the incident approaching the 1,000 metres. He pointed out ARMA XCELLENT with CENTENARY on its outside. Mr McIntyre alleged that Mr Alfeld had attempted a “high risk manoeuvre” on the outer onto Mr Thompson, who was 3-wide on the back of FALCON PERFORMER (M P Jones). Mr Alfeld had attempted to get onto the back of FALCON PERFORMER, which was the favourite for the Race. Mr Alfeld’s actions resulted in his own horse breaking.

Mr Alfeld had no previous breaches of the Rule in the past 12 months and, taking into account his admission of the breach, Mr McIntyre recommended a fine of $200.

Mr Alfeld was fined the sum of $200.
