Decision: Under Rule 869 (3) (b) an information was lodged by Stipendiary Steward Mr C J Allison alleging that Mr J C Hackett drove carelessly when shifting outwards on the final bend causing interference to HAYTON MAJOR, causing this horse to break.

Mr Hackett did not admit the breach, and was aided by Mr Suddaby as his support person throughout the hearing.

Stipendiary Steward Mr Ydgren used several video clips of the alleged incident, highlighting in his belief the sharp outward movement of WILL IT MATTER on to HAYTON MAJOR, driven by R Swain.

Mr Swain stated that in his opinion Mr Hackett’s movement outwards was too quick, not allowing him any time to adjust or make allowance causing his horse to break and lose all chance

Mr Suddaby, on Mr Hackett’s behalf, acknowledged the movement was outward and sharp, but he believed HAYTON MAJOR contributed by hanging in.  Mr Suddaby also stated that HAYTON MAJOR had tangled earlier in the race and was not racing kindly.

DECISION :

--

Clearly in my opinion Mr Hackett has made an error of judgement in moving outwards sharply when insufficiently clear of HAYTON MAJOR, who was racing on his outside.  The sharp movement has caused HAYTON MAJOR to break and lose its chance.  I do not accept that HAYTON MAJOR was ‘hanging in’ or contributed to the incident in any way.

In fixing penalty, Mr Hackett’s recent driving record was taken into account, which showed no charges under this rule in the past twelve months in New Zealand.  Consideration was also given to the level of carelessness, which was deemed at the lower end of the scale.

Mr Hackett was fined the sum of $300.00.
