Following race one an Information was filed pursuant to Rule 871(3) when it was alleged by the informant, Mr C George, that Mr P Boylan, rider of the winner SLUMBER, made a celebratory gesture prior to the winning post.

DECISION & REASON:
--Following race one an Information was filed pursuant to Rule 871(3) when it was alleged by the informant, Mr C George, that Mr P Boylan, rider of the winner SLUMBER, made a celebratory gesture prior to the winning post. Mr Boylan admitted the charge and said it was a "spur of the moment" reaction and his arm went up on its own.
----Mr George demonstrated the film which clearly showed Mr Boylan raising his arm prior to the winning post. He said it was Mr Boylan’s first offence under this Rule and recommended a fine in the range of $100 - $200.
----The Committee considered all submissions and took into account Mr Boylan’s guilty plea, his honesty regarding the incident, and that this was his first charge under this particular Rule. Accordingly we impose a fine of $200.
