--
DECISION AND REASON:
--Following Race 8 an information was filed pursuant to Rule 876(1), when it was alleged by the Informant, Ms L Cropp, rider of CHETTAK that TAALISMAN placed first by the judge, interfered with the chances of CHETTAK placed second by the judge. This interference was alleged to have occurred in the home straight. The margin between first and second at the post was a nose.
--Before commencing the protest, Senior Stipendiary Steward Mr C George confirmed all connections had been informed of the protest.
--Present were ? Mr T Gillies, trainer of TAALISMAN, and rider Mr C Lammas. Mr S Marsh, trainer of CHETTAK and rider Ms L Cropp, and Mr A Smith, co-owner.
--Ms Cropp demonstrated the video films and showed where TAALISMAN moved in on CHETTAK on three occasions. In doing so he bumped CHETTAK putting him off balance, and taking his legs out from under him. Ms Cropp said she was almost put out of the saddle, and the race was no contest. There was no doubt in her mind she should have won.
--Mr S Marsh, trainer of CHETTAK, said the videos were clear and in his opinion the interference clearly cost him the race.
--Mr Lammas, rider of TAALISMAN, maintained he kept a straight line initially. He said the first bump was caused by Ms Cropp moving out which caused him to move inwards and make contact with Ms Cropp. On the second occasion he said the contact did not stop Ms Cropps momentum and in fact the final bump gave her a boost over the line.
--Mr Gillies, trainer of TAALISMAN, agreed with Mr Lammas' statement.
--Mr George said that Mr Lammas clearly moved in and severely hampered Ms Cropp on his inside. He believed the interference clearly affected the result.
--Decision:
--The Committee is clearly of the opinion that interference did take place when TAALISMAN bumped CHETTAK on three occasions, and believed this interference did certainly affect the chances of CHETTAK finishing in a better place.
--In applying their discretion, the Committee has taken into account the severity of the interference suffered by CHETTAK, the stage of the race where it occurred, and the nose margin at the post. Because of these reasons the protest is upheld, and the placings shall now be ?
