Following Race 7, C M Jillings Cup (Stake $40,000 1400 metres) an information was laid against Jockey O P Bosson (rider of BELTHAZAR, no 5) alleging a breach of Rule 871 (1) (d) namely Careless Riding.

--

The information (no. 5224) reads as follows : "in that he permitted his mount BELTHAZAR to shift inwards near the 1,200 metres when not sufficiently clear of BRITISH ENSIGN ridden by T Harris, who was dictated inwards tightening HAGAR ridden by B R Jones and MANDELA ridden by S Spratt".

Mr O P Bosson denied the charge.

The informant called Messrs Troy Harris, rider of BRITISH ENSIGN, no. 6, B R Jones

rider of HAGAR, no.4, and Ms Samantha Spratt (apprentice), rider of MANDELA, no. 2.

Mr T Harris gave evidence and said approximately 100 ? 150 metres after the start

--

O Bosson, rider of BELTHAZAR, angled across the line of his mount. He was dictated inwards onto HAGAR (B Jones) and tightening on to MANDELA.

Mr Jones said at the 150 metre mark he received outward pressure and Troy Harris' mount dictated his line.

--

Ms S Spratt said at approximately the 150 metre mark her mount received tightening due to outward pressure.

--

Assistant Stipendiary Steward Mr T Treweek gave evidence. He demonstrated the incident on the head-on and side-on race films. He said that Mr Bosson had angled in when not sufficiently clear of other runners. He said that he was barely one length clear. He said Mr Bosson had crossed when not sufficiently clear of the other runners.

We record that Mr O Bosson at no stage challenged the evidence of the informant's witnesses.

--

Mr Bosson gave evidence; he said he had made an error of judgement.

--

After carefully reviewing the evidence and the race films (head-on and side-on) we find that at approximately the 150 metres mark O Bosson angled his mount across the line of BRITISH ENSIGN when not the required distance clear. Consequently he was dictated inwards and caused a check to HAGAR and resultant tightening to MANDELA.

--

Accordingly, we find the charge of careless riding proved to the required standard.

PENALTY

--

After hearing submissions on penalty from Mr Coles and Mr Bosson we have determined that a suspension be imposed. Mr Coles sought a suspension.

Taking into account the following : -

  1. Your good riding record.
  2. --
  3. Rule 1122 (2) (b) and (c), stake $40,000, three horses suffered interference.
  4. --
  5. Your explanation - error of judgement ? and the pending engagement to ride Sir Slick at Ellerslie on Saturday in the Champion's Mile, Group 1 $200,000 stake.

CONCLUSION

--

We have determined that a suspension must be imposed.

--

Accordingly, you are suspended from the conclusion of racing on 11 April 2007 up to and including the 18th of April 2007 (3 days).

We record that a substantial fine would not be appropriate in this case.
