Decision:

Mr Knowles, stipendiary steward, lodged a protest after race 11 into the 5th placing of TROJAN under Rule 869(8)(b)) alleging that with approximately 350m to run TROJAN caused interference to SEA KING with SEA KING and LITTLE RUSKY losing their chance.

Judge’s placings were 12, 14, 5, 16, 10, 15.

Mr Knowles demonstrated on the videos that TROJAN, when racing 3 wide, was hanging inwards with its head to the side. TROJAN moved in and the cart of the horse came into contact with the legs of SEA KING causing that horse to break with resulting interference to LITTLE RUSKY.

When questioned by the Committee, Mr Beck, the driver of TROJAN accepted that the horse was hanging and, in so doing, had come into contact with SEA KING. He accepted he had caused interference to that horse.

Mr Knight, trainer of TROJAN, who was present during the inquiry, also accept that TROJAN had caused interference.

--

In exercising our discretion and relegating TROJAN to behind LITTLE RUSKY, we are satisfied TROJAN has moved down on the track and has caused interference to both SEA KING and LITTLE RUSKY and that each of these horses had their chances extinguished as a consequence of this interference.

Amended placings are 12, 14, 5, 16, 15, 2.
