Decision:

An information was lodged by Senior Stipendiary Steward Mr S Ching alleging that with approximately 100 m to run, STREETLIGHT, ridden by Mr L Robinson, moved inwards when insufficiently clear

An information was lodged by Senior Stipendiary Steward Mr S Ching alleging that with approximately 100 m to run, STREETLIGHT, ridden by Mr L Robinson, moved inwards when insufficiently clear, severely checking SHAKY BRIDGE, ridden by Mr Chad Ormsby.

Stipendiary Steward Mr Lawson used several video clips to highlight where the alleged incident took place. Mr Lawson stated that in his opinion STREETLIGHT, ridden by Mr Robinson, was only ? to ? length ahead of SHAKY BRIDGE when STREETLIGHT moved inwards effectively taking SHAKY BRIDGE's line.

Mr Robinson began by using the video explaining that he considered his horse to be one length clear of SHAKY BRIDGE when moving inwards, however, on viewing the film again decided to change his plea to guilty ? this was accepted by the Committee.

Mr Ching then referred to Mr Robinson's riding record for the past 12 months. Apart from a 2 day suspension at Westland in March (for careless riding) Mr Ching stated that Mr Robinson was a senior jockey with approximately 7 ? 8 normal rides on a race day. Mr Robinson, in submission to penalty, reminded the Committee of his excellent riding record and that the South Island racing season was coming to a close and wished the Committee to consider a fine, rather than suspension.

In fixing penalty, the Committee took into consideration the following points :

1. Mr Robinson's guilty plea (albeit late).

2. His excellent riding record in the past 12 months (1 x 2 day suspension).
--
3. Limited opportunities ? winter racing.
--
4. His position as a senior jockey (7 ? 8 rides per race day).

However, the Committee was in full agreement with Mr Ching and Mr Lawson that Mr Robinson failed to take any corrective action to straighten STREETLIGHT, effectively extinguishing any chance that SHAKY BRIDGE had of earning a stake bearing place.

In our opinion the degree of carelessness was in the middle range.

The Committee upheld the charge and suspended Mr Robinson up to and including 17 May 2007; Mr Robinson would be able to fulfil his riding obligations at the Canterbury meeting on Saturday 05 May 2007.
