Meet Title:
Waikato RC - 6 September 2006
Race Date:
2006/09/06
Race Number:
Race 4
Decision: --
Following race four an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr C George, that Ms L Cropp, rider of COTES DU RHONE, committed a breach of that rule.
--
DECISION & REASON:
--Following race four an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr C George, that Ms L Cropp, rider of COTES DU RHONE, committed a breach of that Rule when she shifted inwards when not sufficiently clear of SINGLE MALT (R Allwood), and R Allwood was forced to check his mount to avoid the heels of COTES DU RHONE. This occurred at the 1000 metres.
----Mr J Oatham demonstrated the videos. The head-on showed that soon after the 1200 metre start Ms Cropp started an inward movement. This continued until she came into line with Mr Allwood's mount. At this stage Mr Allwood could be seen to take a firm hold and consequently caused a sharp check to JUDGEMENT DAY (M Carston) who was racing behind SINGLE MALT. The side-on video showed the same incident which, in Mr Oatham's opinion, showed that Ms Cropp was barely one length clear.
----Mr Allwood said that at the most Ms Cropp was 1 ? lengths clear. He could not agree with her that the check was caused by a sudden easing of the pace.
----Ms Cropp claimed that the video did not show that she was the cause of the check suffered by SINGLE MALT. She claimed that she was 1 ? lengths clear, but had to admit to Mr George that she took SINGLE MALT?S line.
----After reviewing all of the relevant videos and other evidence we are of the clear opinion that Ms Cropp is guilty as charged. On her own admission she said that she was less than the required distance clear of SINGLE MALT when she crossed over. This was confirmed by all the other evidence which, in our opinion, showed that the distance was considerably less than she claimed.
----PENALTY:
--Mr George said that he considered the offence was a serious one and detailed her record which showed four suspensions and three warnings in the last 12 months. He asked for a suspension.
--Ms Cropp said she felt that the offence was minor and asked for a light suspension and a fine.
----We agree with Mr George that a suspension is warranted. We do not accept that the offence was minor, and consequently suspend Ms Cropp from riding from after the conclusion of racing on 10 September until the conclusion of racing on 17 September 2006.
