HRNZ seeks a Ruling pursuant to R 1112(1) for the disqualification of the horse ARCEEJAY from the Wobbly's Sports Bar Trot at the Forbury Park TC meeting at Forbury Park Raceway on the 14th of June 2007. HRNZ alleges that ARCEEJAY was entered and started in the race other than under its registered name and was therefore ineligible to race.

Rule 411 states:

(3) No person shall start, or permit to be started in a race, a horse under a name other than its registered name.

(5) A breach of this rule is declared to be a serious racing offence

The relevant disqualification provision is R 1001(3) which provides:

The Judicial Committee may in addition to or substitution of any penalty imposed under sub-rule (2) hereof disqualify from any race and/or any specific period or for life any horse connected with the serious racing offence.

On the 14th of June 2007 Mr M Edmonds started two horses at the Forbury Park TC meeting at Forbury Park Raceway. The two horses were THE BOY WONDER (a maiden trotter) and ARCEEJAY (a one win pacer). THE BOY WONDER was entered for the Wobbly's Sports Bar Trot (Race 1) and ARCEEJAY for the Faulks & Creighton Jewels Success Mobile Pace (Race 11). Mr Edmonds did not attend the meeting and the horses were in the care of Mr D Simpson (Public Trainer/Open Horseman). Following Race 2 Mr Simpson approached the stipendiary stewards and informed them that he had geared up and raced the wrong horse in the first event. Instead of racing THE BOY WONDER he had sent out ARCEEJAY.

Mr Edmonds has admitted a breach of R 411(3) in that the horse that competed in race 1 was ARCEEJAY and not THE BOY WONDER and thus ARCEEJAY has raced under the name of THE BOY WONDER.

In our decision with respect to information number 65187 we have found pursuant to R 1111(1)(d) that Mr Edmonds has committed a breach of R 411(3). Rule 411(5) provides that a breach of that rule is a serious racing offence. In these circumstances we have a discretion under R 1001(3) to disqualify ARCEEJAY.

We are satisfied that ARCEEJAY was ineligible to start in Race 1 and in these circumstances we rule that ARCEEJAY be disqualified from The Wobbly's Sports Bar Trot under the provisions of RR 411(3) and (5) and 1001(3).
