Mr Knowles, stipendiary steward, protested against the 5th placing of ROSES IN MAY alleging that with 100 metres to run ROSES IN MAY broke and shifted ground outwards, checking BUNDA CLIFFS and dislodging M P Jones from the sulky.

Judges placings were 11; 10; 2; 7; 9 (ROSES IN MAY); 5.

Mr Knowles had Mr Allison, stipendiary steward, demonstrate on the head and side-on videos that some 100 metres from the finish ROSES IN MAY went off stride and into a mad gallop. In so doing, the horse moved wider on the track coming into contact with BUNDA CLIFFS, with the consequence Mr Jones was dislodged from the sulky and was dragged along the track before being able to restrain his horse.

Mr D Harris and Mr N Williamson, the trainer and driver of ROSES IN MAY, respectively, were asked to comment on the video and both accepted that ROSES IN MAY moved outwards and interfered with BUNDA CLIFFS.

We are satisfied that ROSES IN MAY galloped for some 60 metres approximately 100 metres from the finish. In so doing, the horse shifted out on the track and came into contact with BUNDA CLIFFS. Mr Jones was dislodged from the sulky of BUNDA CLIFFS and that horse lost all chance as a consequence. Mr Knowles asked that ROSES IN MAY be disqualified pursuant to Rule 1003. BUNDA CLIFFS finished last and, significantly, with respect to disqualification rather than relegation, ROSES IN MAY galloped in excess of 50 metres. In these circumstances we exercise our discretion and disqualify ROSES IN MAY from 5th placing.
