An Information was lodged by Stipendiary Steward Mr TW Taumanu against Horseman Mr M Burley the Driver of Marissa Star alleging that Mr Burley used his whip excessively on his horse over the concluding stages of the race.

An Information was lodged by Stipendiary Steward Mr TW Taumanu against Horseman Mr M Burley the Driver of Marissa Star alleging that Mr Burley used his whip excessively on his horse over the concluding stages of the race.

Rule 869(2)(a) states “No Horseman shall during any race use his whip in an unnecessary, excessive or improper manner.”

Mr Burley admitted the breach and was present at the Hearing.

--

Mr Taumanu demonstrated the incident using the video film.   This showed Mr Burley using his whip on his horse all the way down the straight even though his horse was comfortably clear of the field and ultimately won the race by four lengths.   Mr Taumanu referred to the Use of Whip Guidelines and also pointed to the continuous action from Mr Burley.   In Mr Taumanu’s opinion the actions of Mr Burley were excessive.

Mr Burley acknowledged that his actions did not look good and said that he had got excited and had a rush of blood to the head and had consequently used the whip too much.

I advised Mr Burley that although I understood his excitement I was concerned that he was comfortably clear of the field and as such there were no mitigating factors.

Taking all evidence into account and also Mr Burley’s guilty plea I imposed a fine of $250.00 on Mr Burley.
