Following the running of Race 1, Colleen Breen & Lesley Taylor Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Horseman, Mr F R Bebbington, alleging that Mr Bebbington, as the driver of WENDON?S PRIDE in the race, failed to activate the removeable hood on that horse.

DECISION AND REASONS:

--

Following the running of Race 1, Colleen Breen & Lesley Taylor Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Horseman, Mr F R Bebbington, alleging that Mr Bebbington, as the driver of WENDON?S PRIDE in the race, failed to activate the removeable hood on that horse.

Mr Bebbington admitted the breach and the charge was found proved.

Mr McIntyre said that it was reported to him, on returning to the birdcage, that Mr Bebbington had failed to activate the removeable hood on WENDON?S PRIDE. Mr Escott, Chief Stipendiary Steward, showed on video replay that Mr Bebbington was initially held up for a run. He then got a run and was able to drive the horse out with his right hand but failed to activate the hood.

Mr McIntyre recommended a fine of $100.

Mr Bebbington, in explanation, said that he was unable to get a run and his drive was "pulling double". He said he was able to "squeeze through" a narrow gap only in the last 50 metres. If he had taken one hand off the reins at that stage when he had got a run, the horse may have galloped. He had had trouble getting the horse to race kindly but had got it to do so today with some different gear on.

Mr McIntyre disputed that the horse had been pulling hard and pointed out that Mr Bebbington had been able to drive the horse with the right hand rein.

Having viewed the video replays and considered the submissions of both parties, the Committee fined Mr Bebbington the sum of $100.
