--Mr McIntyre alleged that Horseman T S Chmiel drove carelessly shifting out, checking MICHAEL LEE with approximately 200 metres to run.
--Video evidence of the incident was shown and repeated following a request by Mr Steel, to confirm Mr McIntyre's assertion that MICHAEL LEE was battling and would not have run into a placing or stake bearing position. This was confirmed by the video evidence.
--As Mr Chmiel admitted the breach under Rule 1111 (1) (d) we find the charge proven. Mr Chmiel did not attend the hearing, giving written admission of the charge.
--Submission as to penalty:
--Mr McIntyre asked for a fine of $300. When the Committee questioned whether this was sufficient, Mr McIntyre pointed out that as Mr Chmiel had an excellent record of over 300 drives this season for only one careless driving charge and, in addition to the fine, would lose money as the trainer ($170 or 10% of $1700) and, as a quarter owner, would lose 25% of $1700 ? over $400. This is $570 in addition to the $300 fine ? viz $870 plus; the Committee accepted his request and fined Mr Chmiel $300.
