Following Race 5 an Information was filed requesting a ruling under Rule 865(A) as to whether THE RIVER was denied a fair start.
--Mr Oatham said THE RIVER started from gate 7 and when the gates opened this gate failed to lock back. This caused THE RIVER to be hit on the head and lose approximately 2 lengths.
--Mr C Lomas, rider of THE RIVER, said he was always going to ride the horse back and he did not believe the gate affected his chances. This was confirmed by Mr P Bates, trainer of THE RIVER.
--Accordingly the Committee ruled that THE RIVER be declared a runner.
