ID: JCA20382
Hearing Type (Code):
thoroughbred-racing
Decision:
Mrs L Allpress admitted a breach of Rule 638 (1) (d) in that she allowed her mount JUSTA BUDDY to shift inwards forcing rider Kelly Myers, MAREA ALTA, to check in the final straight.
--
Mrs L Allpress admitted a breach of Rule 638 (1) (d) in that she allowed her mount JUSTA BUDDY to shift inwards forcing rider Kelly Myers, MAREA ALTA, to check in the final straight. Mrs Allpress confirmed that she understood the Rule and also confirmed she admitted the breach.
--Stipendiary Steward Mr N Goodwin used the available films to point out the incident and informed the Committee that her mount moved inwards under pressure and that jockey Allpress kept riding, using the whip after pressure was applied to Miss Myers’ mount.
--Jockey Allpress confirmed her mount rolled inwards and that she should have relieved the inward movement onto Kelly Myers’ mount much earlier. It was an error of judgment.
----
SUBMISSION ON PENALTY
--Mr Goodwin told the Committee that jockey Allpress had last been suspended at Hawke’s Bay where she incurred a four day penalty. Previous to that she was last charged under this rule seven months ago. While confirming that the breach was, he believed, in the medium range, he was concerned at Mrs Allpress’ actions in not relieving the pressure her mount caused earlier. He asked for a suspension of four to six days.
--Mrs Allpress had little to add in her submission, believing she did relieve the pressure albeit a little late.
--After consideration of Mrs Allpress’ riding programme she asked for any penalty to be imposed after racing on Thursday 29 October.
----
PENALTY
--In coming to our decision to impose a period of suspension for this breach of the Rule we have taken into account your guilty plea and your race riding record, bearing in mind that you are jockey who rides regularly and successfully throughout New Zealand. However, the Committee was concerned at your late response in relieving pressure on the inside. While we concur with Stipendiary Steward Mr Goodwin the breach was in the medium range, your lack of judgment must be reflected in the penalty.
--Mrs Allpress, you are suspended from race riding for a period of five days. Your suspension will begin after racing on Thursday 29 October and end after the completion of racing on Wednesday 04 November 2009.
