Decision: -- Rule 869(3)(b): An information was lodged by Stipendiary Steward Mr C Allison alleging that with approximately 900 metres to run B R Shirley, driver of WHEN THE MUSICS OVER, shifted ground outwards sharply checking RUSSLANDS driven by AFH Hunter with a resulting check to CLASSIQUE driven by J W Cox. Mr Allison used film of race 9 to highlight the incident which occurred in the back straight. Mr Allison pointed out where Mr Shirley attempted to move out from the two wide lane - thereby checking RUSSLANDS (Mr A F Hunter), with a resulting check to CLASSIQUE (Mr J Cox). Mr Allison maintained that whilst the move was quite legal, Mr Shirley, WHEN THE MUSICS OVER, had shifted ground sharply outwards, checking RUSSLANDS, who in turn checked CLASSIQUE. Mr Shirley, in explanation, agreed with the evidence as presented, stating that it was his intention to move outwards gradually but his horse flicked his head and ducked outwards too quickly. Mr Shirley took full responsibility, Mr Hunter did call out but that the incident happened too quickly to correct it. Mr Allison reminded Mr Shirley that his actions affected the chances of two horses. Before considering penalty, the Committee asked for evidence of Mr Shirley's recent driving record over the last 12 months. Mr Allison reported that Mr Shirley was a 'competitive' driver with an excellent record and suggested that a fine of $250 would fairly match the breach of rule. Mr Shirley agreed that this was fair. DECISION: After a brief deliberation, the Committee fined Mr Shirley the sum of $250 taking into account his: The Committee then reminded Mr Shirley of his obligations as an experienced driver.
